1. Agreement to These Terms

These Terms of Service (the "Terms") are a binding agreement between you and NURIWORKS, a company incorporated in the Republic of Korea with its address at 16, Sapyeong-daero, Seocho-gu, Seoul, Republic of Korea 06552 ("NURIWORKS", "we", "us" or "our"). They govern your use of the HavFun social casino game on Steam (the "Game"), the website at www.socialcasinohavfun.com (the "Site") and related services (together, the "Services").

By creating an account, downloading the Game or otherwise using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

IMPORTANT NOTICE

  • The Services are a social casino game for entertainment purposes only.
  • The Services do not offer real-money gambling and do not offer any opportunity to win real money or prizes of real-world value.
  • Virtual chips and other virtual items have no cash value and cannot be exchanged, transferred, sold or redeemed for money, goods, services or anything of value.
  • The Services contain optional in-game purchases.
  • The Services are intended only for adults of legal gambling age and are not available in the State of Washington.

2. Eligibility

2.1 Age. You may use the Services only if you are at least 18 years old or the legal gambling age in your place of residence, whichever is higher. The Services are not directed to minors, and we do not knowingly allow minors to use them. If we learn that a user does not meet this requirement, we will close the account.

2.2 Where the Services are available. The Services are offered only where social casino games are lawful. The Services are not available to residents of, or persons located in, the State of Washington, and we block access to the Game from that state. You may not use a VPN or any other means to hide your location to access the Services from a place where they are not offered.

2.3 Your responsibility. You are responsible for making sure that your use of the Services is lawful where you live.

2.4 One account. You may hold only one account. Your account is personal to you.

3. Social Casino Game — No Real-Money Gambling

3.1 Entertainment only. The Game contains simulated casino-style games, such as slots, card games and table games, provided for entertainment only.

3.2 No real-money gambling. We do not offer, operate or promote real-money gambling. You cannot wager real money in the Game.

3.3 No prizes of value. You cannot win real money, cash equivalents, gift cards, coupons, merchandise or any other prize of real-world value through the Services. Results in the Game only change the amount of virtual chips or virtual items in your account.

3.4 No sweepstakes or prize promotions. We do not run sweepstakes, prize draws or promotions that award prizes of real-world value in connection with the Game.

3.5 Practice disclaimer. Practice or success at social casino gaming does not imply future success at real-money gambling.

3.6 No real-money gambling brands. The Services do not use the names, logos or marks of real-money gambling operators, and the Services are not affiliated with any of them.

4. Virtual Chips and Virtual Items

4.1 Limited license. The Game uses virtual chips and other virtual items (together, "Virtual Items"). Virtual Items are not your property. When you obtain Virtual Items, we grant you a limited, personal, non-transferable, non-sublicensable, revocable license to use them only within the Game.

4.2 No cash value. Virtual Items have no monetary value and are not money, currency, a deposit or a stored-value instrument.

4.3 No exchange, transfer or redemption. Virtual Items cannot be:

  • exchanged or redeemed for real money, goods, services or anything of real-world value;
  • sold, bought, traded, gifted or transferred to another user or account;
  • cashed out or refunded in cash, except where required by applicable law.

The Game does not include gifting, trading, auction or mail features for Virtual Items.

4.4 Separate from other HavFun services. Virtual Items in the Game are used only in the Game. They are not shared with, converted into or transferred to or from any other HavFun app or service, and currencies or rewards from other HavFun services cannot be used in the Game.

4.5 Changes. We may change, rebalance or discontinue Virtual Items as part of operating the Game. If we permanently discontinue the Game, we will give at least 30 days' notice in the Game or on the Site.

5. In-Game Purchases and Refunds

5.1 Optional purchases. The Game is free to play. You may choose to buy Virtual Items. Purchases are optional and are not required to play.

5.2 Payment through Steam. All purchases are made through your Steam account and processed by Valve Corporation under the Steam Subscriber Agreement. We do not collect or store your payment card details. Prices are shown at checkout.

5.3 What you buy. A purchase gives you the limited license to Virtual Items described in Section 4. It does not give you anything of monetary value.

5.4 Refunds. Refunds are handled under Steam's refund policy. Under that policy, in-game purchases in non-Valve games are refundable through Steam only if the developer has enabled in-game refunds, and Steam tells you at the time of purchase whether a refund is available. Nothing in these Terms limits any refund right you have under applicable law. Contact us at admin@havfun.com about purchase problems.

5.5 Spending controls. You can manage spending through Steam's account and family settings. Please play within your means.

6. Prohibited Conduct

You must not:

  1. Sell, buy, trade or transfer Virtual Items or accounts for real money or anything of value, on or off the Services ("real-money trading").
  2. Use, offer or promote any third-party service that claims to exchange Virtual Items for money or prizes.
  3. Use the Services to gamble, place side bets or arrange any wager of value with other people.
  4. Share, sell or let others use your account.
  5. Use bots, scripts, cheats, exploits or automated tools, or interfere with the Services.
  6. Hide or falsify your age or location, including by VPN.
  7. Reverse engineer the Game or extract its source code, except where the law allows.
  8. Harass, threaten or impersonate others, or post unlawful, hateful or sexual content.
  9. Infringe anyone's intellectual property or privacy.

If you break this Section, we may remove Virtual Items obtained through the violation and suspend or close your account under Section 9.

7. Responsible Play

We want the Game to stay fun. Take breaks, set limits on your time and spending, and stop if play stops being enjoyable.

8. Advertising and Third-Party Links

8.1 No gambling advertising. We do not display, and do not allow our advertising partners to display, advertisements for real-money gambling, sports betting, sweepstakes casinos or similar services in the Game or on the Site.

8.2 Third-party links. The Site links to Steam and to responsible-play resources. We are not responsible for third-party sites, and their own terms apply.

9. Accounts, Suspension and Termination

9.1 Account security. You are responsible for keeping your login details secure and for activity on your account.

9.2 Our rights. We may suspend or close your account if you break these Terms, provide false information, do not meet the eligibility rules in Section 2, or if the law requires it.

9.3 Your rights. You may stop using the Services and ask us to close your account at any time.

9.4 Effect on Virtual Items. When an account is closed, the license to its Virtual Items ends. Because Virtual Items have no cash value, no cash or other compensation is paid for them, except where required by applicable law.

10. Intellectual Property and Privacy

10.1 Our content. The Services, including characters, artwork, music, text and software, belong to NURIWORKS or its licensors. We grant you a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial entertainment under these Terms.

10.2 Your content. You keep ownership of content you post. You grant us a worldwide, royalty-free, non-exclusive license to host, display and use it to operate and promote the Services.

10.3 Privacy. Our Privacy Policy explains how NURIWORKS, as data controller, handles your personal information.

11. Disclaimers, Liability and Legal Terms

11.1 Disclaimer. The Services are provided "as is" and "as available". To the extent permitted by law, we make no warranties that the Services will be uninterrupted or error-free.

11.2 Limitation of liability. To the extent permitted by law, NURIWORKS is not liable for indirect, incidental, special or consequential damages. Nothing in these Terms excludes liability that cannot be excluded by law.

11.3 Governing law. These Terms are governed by the laws of the Republic of Korea, without affecting any mandatory consumer protection rights you have under the laws of the place where you live.

11.4 Disputes. Before starting a formal dispute, please contact us at admin@havfun.com so we can try to resolve it. Disputes are subject to the jurisdiction of the courts of the Republic of Korea, except where the law of your place of residence gives you the right to bring a claim locally.

11.5 Changes to these Terms. We may update these Terms. We will give at least 7 days' notice in the Game or on the Site before changes take effect, or 30 days for changes that materially reduce your rights. If you continue to use the Services after that date, the updated Terms apply.

11.6 Other. If any part of these Terms is invalid, the rest remains in effect. Our failure to enforce a right is not a waiver. These Terms are the entire agreement between you and NURIWORKS about the Services.
